2.2 We agree to provide and maintain the NewFriends4U.com web site. By registering your free Membership You agree to abide by the Terms & Conditions.

2.3 You shall, if Your email address changes, amend Your details with Your new email address immediately or mail forwarding to yourself will not be guaranteed and we take no responsibility for subsequent loss of mail therein or any other Liability. If we are notified your email address is invalid your profile will be removed from our database

2.4 Your details and Profile will be displayed on NewFriends4U.com and as a Member You will be able to view the details and Profiles of other Members.

2.5 You are agreeing to accept Newfriends4u.com newsletters. (To unsubscribe from our newsletter mailings You are provided a link and can unsubscribe at anytime or by using your profile options). (2) You are agreeing to receive notification mailings related to your on-site message box, about your Profile status, log on activity, members who like you and have added you to their favourites.

2.6 You acknowledge that any details Posted by You on NewFriends4U.com web site will be able to be accessed by the Members.

2.7 You are solely responsible for Your own interactions with other Members.

2.8 You shall be responsible for the accuracy of any information necessary for Us to perform NewFriends4U.com Service and for Your interactions with other Members.

2.9 Your registration is solely for you, we will only accept one person per profile.

2.10 Your application for membership shall come into effect once you have activated your account to confirm your email address and We have notified acceptance of your membership by email as confirmation.

2.11 We reserve the right to remove for any reason any information, text, photographs and/or other material Posted by You, which is deemed unacceptable for the site.

2.12 We reserve the right to refuse any application for membership.

2.13 We reserve the right to remove or delete any account, including private messages by you, to restrict, suspend, or terminate your access to all or any part of the New NewFriends4U service which violates our terms of service without prior notice.

2.14 We reserve the right to change any of the terms and conditions of this agreement at any time and in its sole discretion by posting a new agreement on the Newfriends4u.com website. You agree it is your responsibility to check our Terms and Conditions for any changes.

2.15 We reserve the right to make changes to NewFriends4U.com Service as deemed necessary or desirable.

3. TERMINATION
3.1 If You decide to terminate this Agreement you can do so by either removing your account immediately using your Profile Options or by email to us.

3.2 NewFriends4U.com will have the right of termination of this Agreement, without notice, If the information that You provide is found to be untrue or if You breach the terms of this Agreement.

3.3 If Our Internet provider reports that Your email address no longer exists then NewFriends4U.com will subsequently remove Your account.

3.4 We will remove your account from Our database immediately, without notice, if you:

a) send spam/scam messages with the intention to obtain money from our members.
b) send messages containg an exernal URL, or ‘any’ other means, to alternative website or destinations that contains information about you.
c) redirect members to an outside email address in your initial contact.
d) send excessive quantity of duplicate contact messages.
e) use offensive language.
f) use for advertising or commercial use including affiliate links
g) send offensive messages containing overt solicitation for sex or descriptions of sexual activity, anatomy, etc solicitation of multiple or additional partners.
h) send flaming and retaliation messages.
i) advertise for functions, parties or engagements of a similar nature or for commercial pupose

4. OBLIGATION OF MEMBER
4.1 Your Profile may not contain:

a) details of Your surname, street/postal address, company name, email address, telephone numbers, Skype or any other type of contact information including URLS.
b) Requests for members email addresses.
c) Statements about your membership status. 
D) Any photographs containing nudity, or obscene, lewd, excessively violent, harassing, sexually explicit or otherwise objectionable subject matter.

4.2 You may not use NewFriends4U.com to promote another site, service and/or business in any way.

4.3 You may not copy and upload another members photo, any photos of celebrities or any copyright material to your profile, doing so will result in your account being removed from the site.

4.4 You will not transmit and/or Post any chain letter and/or junk e-mail to other Members; solicit other Members' business, buy or sell products and/or services through NewFriends4U.com.

4.5 You will not Misuse in any way NewFriends4U.com Service or any information Posted on NewFriends4U.com.

4.6 You will not Post and/or reproduce in any way any information and/or material in which the copyright, trade mark and/or intellectual property belongs to another party without first obtaining the prior consent of the owner of such rights.

4.7 You will not In any way assign, transfer, part with and/or authorize any other person/member to use (A) Your membership/account or (B) transmit and/or Post and/or email to another Member any information, pictures and/or any other material, which in our opinion is sexually explicit, racist, abusive, threatening or likely to cause offence to another Member.

4.8 You are entirely responsible for maintaining the confidentiality of your password.

4.9 You agree not to hold NewFriends4U.com liable for anything stated or messages posted within the forums.

4.10 You agree not to contact us by email sending aggressive, disrespectful, impolite, vulgar, defamatory content or threats. Doing so your account will be terminated immediately.

4.11 We take no liability for any events organised through using our service.

5. FEES
5.1 Registering on NewFriends4U.com is free.

5.2 NewFriends4U.com reserves the right to alter or cease offering any part of the service free of charge at any time. 

5.3 You will be required to pay a subscription fee to use certain paid features of the service. If You wish to use these paid features You must pay the fees that are specified on the web site. As a paid user Your basic free membership of NewFriends4U.com is upgraded to premium membership for the period You selected, your membership will revert to basic free membership after expiry of your premium membership.

5.4 Fees are only accepted as displayed in USD, Euros or GBP (Pounds Sterling).

5.5 Any mistakes You make during the upgrading process cannot be refunded or credited to your account. 

5.6 Our 'open policy' is designed to help you make a considered choice in advance before You upgrade to premium membership. We don't therefore offer refunds after the point of becoming a paying member as we have opened our entire website services to you.  By upgrading your membership You waive all rights and privileges, without reserve, regarding current and future distance selling regulations and waive any rights and privileges, without reserve, regarding 'cooling off periods' or the similar.

6. INTELLECTUAL PROPERTY RIGHTS AND CONFIDENTIALITY
6.1 All copyright and design rights are owned by NewFriends4U.com Limited and are not available for use by any other party.

6.2 By displaying or publishing ("posting") any Content on or through the NewFriends4U.com Services, you hereby grant to NewFriends4U.com a limited license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the NewFriends4U Services and is non-exclusive. You warrant that you own the content posted by you or you agree to pay for all royalties, fees, and any other monies owing any person by reason of any content posted by you or through NewFriends4U.com service. The license will terminate upon removal of your content from NewFriends4U.com

6.3 We recognise Our responsibilities under the Data Protection Act and We will keep Your personal details such as Your name, e-mail address confidential and will not disclose such information, except if required to be disclosed by law.

6.4 You use NewFriends4U at entirely your own risk. It is a known that people are not necessarily who they say they are. People may provide information or behave in a way that is unreliable, misleading, unlawful or illegal. This is a decision that can only be made at your discretion and we recommend exercising a degree of caution. By using NewFriends4U and its services you accept that this is the case and accept the risk associated therewith. NewFriends4U ask that users take particular care in relation to the disclosure of their own personal information including surname, address, email address, IM, telephone number, place of work and places they go out. NewFriends4U also make this recommendation in every contact notification email sent to you by our members via our system.

7. GUARANTEE
7.1 NewFriends4U.com is provided in its current form and We cannot guarantee that NewFriends4U.com Service, or any element of NewFriends4U.com will meet Your requirements, purpose and/or expectations.

7.2 We do not provide any warranty in respect of the Service, results, availability, activity and/or uninterrupted use, if for any reason there is an interruption to Our server provider or if it should become necessary to move NewFriends4U.com Service to another server.

7.3 Whilst We make every endeavour to make sure that all information and /or material provided by Us is accurate We do not guarantee that this is the case.

8. LIMITATIONS ON LIABILITY
8.1 We accept no Liability for any defect in the Service caused or contributed to by You and/or any other Member.

8.2 We accept no Liability to You arising out of Your use of NewFriends4U.com and/or Your reliance on any information and/or other material Posted on NewFriends4U.com or Posted to You by other Members.

8.3 We accept no Liability to You arising out of any Member's and/or unauthorized user's misuse of information and/or other material Posted by You on NewFriends4U.com and/or to other Members.

8.4 Under no circumstances whatsoever shall NewFriends4U.com be responsible or liable for any loss or damage of any kind whatsoever which You may suffer or incur directly or indirectly through the use of the NewFriends4U.com web site.

8.5 We accept no responsibility for false information disclose or for the use of any information entered and used by "Hackers" or third parties.

8.6 No copyrighted or trademarked information of names or the site itself will be used, if so, the user of such is subject to liability

8.7 Nothing in this Agreement shall exclude or limit any of Your statutory rights.

9. FORCE MAJEURE
9.1 We will not be liable or deemed to be in breach of contract by reason of delay or failure to perform any of Our obligations if this delay or failure was due to any cause beyond Our reasonable control.

10. INDEMNITY
10.1 You agree to indemnify Us against any and all losses, proceedings, lost profits, damages, awards, expenses, costs (including increased administration costs and legal costs on a full indemnity basis), claims, actions and any other losses and/or liabilities suffered by NewFriends4U.com and arising from and/or relating to Your use of NewFriends4U.com, information and/or other material Posted on NewFriends4U.com by You and/or arising from or due to any breach of contract, any tortious act and/or omission and/or any breach of statutory duty by You.

11. GENERAL
11.1 All third party rights are excluded and no third parties shall have any right to enforce this Agreement.

11.2 These Terms and Conditions are subject to the law of England and Wales and the exclusive jurisdiction of the courts of England and Wales.

11.3 No waiver by NewFriends4U.com of any breach of this Agreement shall be considered as a waiver of any subsequent breach of the same provision or any other provision.
